1. Acceptance of Terms

By creating an account, accessing, or using the Lumira Health platform, website, mobile application, AI voice assistant, or any related services (collectively, “the Service”), you acknowledge that you have read, understood, and agree to be bound by these Terms & Conditions (“Terms”), our Privacy Policy, and all applicable laws and regulations. If you do not agree to these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you (“User,” “you,” or “your”) and Lumira Health (“Company,” “we,” “us,” or “our”), a licensed insurance agency. By proceeding with account creation, you confirm that you are at least 18 years of age and legally capable of entering into binding agreements.

2. Description of Service

Lumira Health is a technology-powered licensed insurance agency that provides health coverage guidance, plan comparison, enrollment assistance, and related services. Our platform uses artificial intelligence, including voice-based AI assistants and chat-based tools, to help individuals navigate their health insurance options.

The Service includes, but is not limited to:

  • AI-powered health coverage consultations (voice and text)
  • Personalized plan recommendations based on your health profile, location, and coverage needs
  • Enrollment assistance for Medicare Advantage (MA/MAPD), Medicare Supplement (Medigap), Prescription Drug Plans (PDP), Affordable Care Act (ACA) Marketplace plans, dental, vision, hearing, hospital indemnity, cancer/heart/stroke, and life insurance products
  • Digital health management tools and educational resources
  • Ongoing coverage review and annual enrollment guidance

The Service is provided at no direct cost to members. Lumira Health is compensated through commissions paid by insurance carriers upon successful enrollment, which is standard industry practice and does not affect the premiums you pay.

3. Licensed Agent Relationship & Broker of Record

By creating an account and using the Service, you acknowledge and agree that Lumira Health, operating under the direction of its licensed principal agent, will serve as your insurance broker and agent of record for the purpose of providing health coverage guidance and facilitating enrollment in insurance products. Your assigned licensed agent will be identified in your account and associated correspondence.

Your licensed agent is responsible for ensuring that all recommendations are suitable for your individual circumstances, that all required disclosures are made, and that enrollment is conducted in compliance with applicable federal and state regulations, including but not limited to CMS (Centers for Medicare & Medicaid Services) marketing guidelines and state department of insurance requirements.

This broker relationship remains in effect for the duration of your enrollment in any plan facilitated through the Service, unless you provide written notice to change your agent of record. You may terminate this relationship at any time by contacting us or your insurance carrier directly.

4. Scope of Appointment & Plan Discussion Authorization

In accordance with CMS regulations and applicable state requirements, this section serves as your digital Scope of Appointment (SOA). By creating an account and using the Service, you authorize Lumira Health and its licensed agents to contact you and discuss the following types of insurance products:

  • Medicare Advantage Plans (MA/MAPD) — including HMO, PPO, and Special Needs Plans (SNP)
  • Medicare Supplement Plans (Medigap) — Plans A through N
  • Medicare Prescription Drug Plans (Part D/PDP)
  • ACA Marketplace Plans — individual and family health insurance under the Affordable Care Act
  • Dental, Vision, and Hearing Plans
  • Hospital Indemnity Insurance
  • Cancer, Heart Attack, and Stroke Insurance
  • Life Insurance — term, whole, and final expense

You understand that this authorization is voluntary and that you are not obligated to enroll in any plan. This Scope of Appointment does not constitute enrollment in, or an obligation to purchase, any insurance product. You may limit or revoke this authorization at any time by updating your preferences in your account settings or by contacting us directly.

This SOA is valid for twelve (12) months from the date of your account creation or most recent consent, whichever is later, and will automatically renew upon your continued use of the Service unless revoked. A copy of this Scope of Appointment is available in your account and may be downloaded or printed for your records.

5. Medicare & Government Program Disclaimer

Lumira Health is not connected with or endorsed by the United States government or the federal Medicare program. We do not offer every plan available in your area. Any information we provide about Medicare is not a complete description of benefits. For complete information, contact the plan directly. Limitations, copayments, and restrictions may apply. Benefits, premiums, and/or member cost-sharing may change on January 1 of each year.

6. ACA Marketplace Disclaimer

Lumira Health assists individuals in exploring and enrolling in Affordable Care Act (ACA) Marketplace health insurance plans. We are not the Health Insurance Marketplace (HealthCare.gov) and are not a government agency. Eligibility for premium tax credits and cost-sharing reductions is determined by the Marketplace based on household income and other factors. We provide guidance but cannot guarantee subsidy amounts or plan availability.

7. AI-Generated Information & Limitations

Lumira Health utilizes artificial intelligence technology to provide health coverage guidance, plan comparisons, and recommendations. While we make every effort to ensure accuracy, you acknowledge and agree that:

  • AI-generated information is for educational and guidance purposes and should not be considered medical or legal advice
  • Recommendations are based on the information you provide and may not account for all individual circumstances
  • Plan details, benefits, premiums, formularies, and provider networks may change and should be verified directly with the insurance carrier before making enrollment decisions
  • A licensed agent is available to review and confirm all plan recommendations prior to enrollment
  • Voice conversations with our AI assistant may be recorded and transcribed for quality assurance, compliance, and service improvement purposes

8. User Account & Responsibilities

You are responsible for maintaining the confidentiality of your account credentials and for all activity that occurs under your account. You agree to:

  • Provide accurate, current, and complete information during registration and throughout your use of the Service
  • Promptly update your account information if it changes
  • Notify us immediately of any unauthorized use of your account
  • Not share your account credentials with any third party
  • Use the Service only for legitimate health insurance guidance purposes
  • Not attempt to reverse-engineer, decompile, or misuse our AI technology or proprietary systems
  • Not use the Service for any unlawful or fraudulent purpose

9. Consent to Contact

By creating an account and providing your contact information, you expressly consent to receive communications from Lumira Health and its licensed agents via email, telephone, text message (SMS), and push notification regarding your health coverage options, enrollment status, plan updates, renewal reminders, and related service communications.

You understand that: (a) your consent is not a condition of purchasing any insurance product; (b) message and data rates may apply for text messages; (c) you may opt out of non-essential communications at any time through your account settings or by replying STOP to any text message; and (d) essential service communications related to active enrollments may continue as required by applicable regulations.

10. Privacy & Data Protection

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, store, and protect your personal and health information. By using the Service, you consent to our data practices as described in the Privacy Policy.

We implement industry-standard security measures, including encryption of data in transit and at rest, to protect your information. However, no method of transmission over the Internet or electronic storage is 100% secure, and we cannot guarantee absolute security.

11. HIPAA Authorization

By accepting these Terms and completing the HIPAA authorization during registration, you authorize Lumira Health, its licensed agents, and its technology systems to access, collect, use, and store your Protected Health Information (PHI) as defined under the Health Insurance Portability and Accountability Act of 1996 (HIPAA), as amended, for the following purposes:

  • Evaluating your health insurance needs and eligibility
  • Providing personalized plan recommendations
  • Facilitating enrollment in health insurance plans
  • Communicating with insurance carriers on your behalf
  • Annual coverage review and renewal assistance
  • Service improvement and quality assurance

This authorization does not expire automatically but may be revoked by you in writing at any time. Revocation will not affect information already disclosed under this authorization. You have the right to receive a copy of this authorization.

12. Intellectual Property

All content, technology, design, branding, software, AI models, and proprietary systems comprising the Service are the exclusive property of Lumira Health and are protected by applicable intellectual property laws. You are granted a limited, non-exclusive, non-transferable license to use the Service for its intended purpose. You may not copy, modify, distribute, sell, or lease any part of the Service without prior written consent.

13. Limitation of Liability

To the maximum extent permitted by applicable law, Lumira Health, its owners, officers, agents, affiliates, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, data, use, or other intangible losses, arising out of or in connection with your use of the Service.

Enrollment decisions are ultimately the responsibility of the User. Lumira Health shall not be liable for any damages arising from enrollment in a plan that does not meet your expectations, changes in plan benefits after enrollment, or inaccuracies in information provided by insurance carriers or third-party data sources.

Our total liability for any claim arising from or related to the Service shall not exceed the greater of one hundred dollars ($100.00) or the amount you paid to Lumira Health in the twelve (12) months preceding the claim.

14. Indemnification

You agree to indemnify, defend, and hold harmless Lumira Health, its owners, officers, agents, affiliates, and employees from any claims, damages, losses, liabilities, and expenses (including reasonable attorneys' fees) arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.

15. Dispute Resolution & Arbitration

Any dispute, controversy, or claim arising out of or relating to these Terms or the Service shall first be submitted to good-faith mediation. If mediation is unsuccessful, disputes shall be resolved through binding arbitration conducted in accordance with the rules of the American Arbitration Association (AAA) in the state of Washington. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.

16. Termination

We reserve the right to suspend or terminate your account and access to the Service at any time, with or without cause, and with or without notice. You may terminate your account at any time by contacting us. Upon termination, your right to use the Service will immediately cease. Provisions of these Terms that by their nature should survive termination shall survive, including but not limited to intellectual property, limitation of liability, indemnification, and dispute resolution.

17. Modifications to Terms

Lumira Health reserves the right to modify these Terms at any time. We will notify you of material changes via email or through the Service. Your continued use of the Service after such notification constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.

18. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Washington, without regard to its conflict of law provisions. Any legal action arising under these Terms shall be brought exclusively in the state or federal courts located in Washington.

19. Severability

If any provision of these Terms is found to be unenforceable or invalid by a court of competent jurisdiction, that provision shall be limited or eliminated to the minimum extent necessary, and the remaining provisions shall remain in full force and effect.

20. Entire Agreement

These Terms, together with the Privacy Policy, HIPAA Authorization, and Scope of Appointment incorporated herein, constitute the entire agreement between you and Lumira Health regarding the use of the Service and supersede all prior agreements and understandings, whether written or oral.
